8. Jurisdictional Coverage

MotivePass operates primarily in Nigeria under the Nigeria Data Protection Act 2023 (NDPA). We are registered with the Nigeria Data Protection Commission (NDPC). Our Data Protection Officer can be reached at dpo@motivepass.com.

For South African users, the Protection of Personal Information Act (POPIA) applies. We honor the eight data-subject rights under POPIA.

For EU/EEA users, the General Data Protection Regulation (GDPR)applies. We are GDPR-compliant per the Data Protection Act's adequacy framework.

9. Data Subject Rights (NDPR / POPIA / GDPR)

You have the following rights under applicable data protection laws:

• Right of access (Art. 15 GDPR / Sec. 37 NDPA / Sec. 23 POPIA)
• Right of erasure / right to be forgotten (Art. 17 GDPR / Sec. 37 NDPA)
• Right to data portability (Art. 20 GDPR)

10. Cross-Border Transfers

Data may be processed on Supabase infrastructure in eu-west-1(Ireland). For NDPR purposes, this constitutes a cross-border transfer; the legal basis is the EU's adequacy decision recognized by the NDPC.

11. Data Retention

We retain your information for as long as your account is active or as needed to provide services. We may retain certain information for longer periods as required by law or for legitimate business purposes.

12. Children's Privacy

Our platform is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18.

13. Data Subject Access Requests (DSAR)

Under the Nigeria Data Protection Act (NDPA), POPIA, and GDPR, you have the right to request deletion of your personal data. You may exercise this right by clicking the button below (requires sign-in):

Deleting your account will anonymize your personal data. Your order history will be retained for legal and financial compliance but all PII will be redacted. This action is irreversible.
